Clear Property Titles

It is possible to receive clear Mexican property title and receive Owner's Policies of Title Insurance that can be issued on both sides of the border from various companies to both U.S. and Mexican buyers.

In 1996 the Stewart Title Guaranty Company began underwriting title insurance for Mexican properties at an approximate cost of 1% of the insured amount. Other types of insurance, including property, liability, damage, and earthquake, are all readily available in Mexico, at low cost, and policies can be written to pay claims in U.S. dollars.

Personal Property Titles ...........................Top

Foreigners may obtain direct ownership of property in the interior of Mexico . However, under Mexican law, foreigners cannot own property "outright" within the restricted zone that extends 50 km inland from the coastline.

Outside the Restricted Zone, a foreigner is able to acquire land and be direct owners of the property with all the rights of a Mexican national in compliance with Mexican Law.

Inside the 50 km Restricted Zone, there are two alternatives for foreigners who wish to buy real estate. One is through a Mexican bank trust, known as a Fideicomiso and the other by establishing a Mexican corporation.

Investment Property Titles ......................Top

A Mexican corporation can be established to hold title to all NON-residential property. This includes apartments and houses which are used entirely for rental and/or commercial purposes.

For properties owned by the corporation, an IVA, sale, tax of 15% of the value of the construction is charged at the time of purchase in addition to the 2% acquisition tax. Corporate tax declarations must be filed monthly and estimated taxes paid monthly. Property taxes are charged at a commercial rate, not residential, as utilities will be.
